1. Use of Website & Sales Channels
By accessing the website of Nilvi (“we”, “our”, “us”) or placing an order through our website, Instagram, WhatsApp, exhibitions, or any other sales channel, you agree to be bound by these Terms & Conditions and all applicable laws of India.
Nilvi reserves the right to modify or update these Terms & Conditions at any time without prior notice. Continued use of our website or services after such changes constitutes acceptance of the revised terms.
2. Product Information & Disclaimer
All products sold by Nilvi are carefully curated handloom and handcrafted sarees. Due to the nature of handloom and artisanal processes:
• Minor irregularities in weave, print, texture, or colour are natural and are not defects.
• Product images are captured to best represent the actual product; however, colour variations may occur due to lighting conditions and screen/display differences.
• All products are sold on an “as is” basis without any express or implied warranties, including but not limited to warranties of merchantability or fitness for a particular purpose.
Nilvi does not warrant that the website content, product descriptions, or images are free from errors or omissions.
3. Limitation of Liability
To the maximum extent permitted under applicable law:
• Nilvi shall not be liable for any direct, indirect, incidental, special, consequential, or remote damages, including loss of profits, loss of revenue, or business interruption arising from the use of the website or purchase of products.
• Nilvi’s total cumulative liability, if any, shall not exceed the amount paid by the customer for the specific product giving rise to the claim.
4. Pricing
• All prices are listed in Indian Rupees (INR).
• Prices are firm and final at the time of order confirmation.
• Nilvi reserves the right to revise prices at any time without prior notice.
• In the event of an incorrect price being displayed, Nilvi reserves the right to cancel the order and refund the amount or contact the customer for confirmation before dispatch.
• Shipping charges, if applicable, are calculated and communicated before order confirmation.
5. Orders, Payments & Cancellations
• Orders are confirmed only upon receipt of full payment.
• Once an order is placed and payment is made, cancellations are not permitted.
• Nilvi reserves the right to refuse or cancel any order at its sole discretion.
6. Shipping & Delivery
• Dispatch and delivery timelines provided are estimates only.
• Nilvi shall not be held responsible for delays caused by courier partners, natural events, strikes, or other unforeseen circumstances.
• Title and risk of loss of the merchandise pass to the customer upon handover of the product to the shipping carrier.
7. Returns, Exchanges & Refunds
• All sales are final.
• Nilvi does not offer returns, exchanges, or refunds.
• Customers are encouraged to clarify all queries before placing an order.
Damaged or Incorrect Product
In the unlikely event that a damaged or incorrect product is received:
• An unboxing video (without cuts or edits) is mandatory.
• The issue must be reported within 24 hours of delivery.
• Complaints raised after this period or without an unboxing video will not be entertained.
• Any resolution (replacement or store credit) will be provided solely at Nilvi’s discretion.
8. Wash & Care Disclaimer
• Dry clean is recommended unless stated otherwise.
• Nilvi shall not be responsible for colour bleeding, shrinkage, or damage due to washing, handling, or storage after delivery.
9. Custom & Made-to-Order Products
• Customised or made-to-order products are non-returnable, non-exchangeable, and non-refundable.
• Once production has commenced, modifications or cancellations are not permitted.
10. Intellectual Property
All content on the Nilvi website and social media platforms, including images, videos, logos, designs, and text, is the exclusive property of Nilvi. Unauthorized copying, reproduction, or commercial use is strictly prohibited.
11. Jurisdiction & Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of India.
All disputes shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India.
12. Miscellaneous
• Failure by Nilvi to enforce any right shall not be deemed a waiver of such right.
• If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• These Terms constitute the entire agreement between Nilvi and the customer and supersede all prior communications.
